Article 1: General Provisions
The e-commerce website of Luc De Maeght, a one-man business with registered office in Loppem Brombilk 14 , VAT BE 0764 619 326, hereinafter referred to as Saint of Love offers its customers the opportunity to purchase the products from its web store online.

 
These Terms and Conditions ("Terms and Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order through Saint of Love's online store, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, except when previously, in writing and expressly accepted by Saint of Love.


Article 2: Price
All prices stated are expressed in EURO, always including VAT and all other taxes or duties that the Customer is obliged to pay. 

If delivery, reservation or administrative costs are charged, this will be stated separately.

The indication of price refers only to the items as it is described verbatim. The accompanying photographs are for decorative purposes and may contain elements not included in the price.


Article 3: Offer

Despite the fact that the online catalog and e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Saint of Love. Saint of Love is as far as the correctness and completeness of the offered information is concerned only held to a means obligation. Saint of Love is in no case liable in case of manifest material errors, typesetting or printing errors.


If the Customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we request the Customer to contact our customer service department in advance. 


Offers are always valid while supplies last and may be modified or withdrawn by Saint of Love at any time.

Saint of Love cannot be held liable for the unavailability of any product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.


Article 4: Online Purchases
The Customer has the choice between the following payment methods :

  • Credit Card

  • Bancontact

  • Apple Pay

  • KBC app

  • Belfius app

  • iDEAL

Saint of Love is entitled to refuse an order due to serious default of the customer in relation to orders involving the customer.

Article 5: Delivery and execution of the agreement
Saint of Love endeavors to prepare the purchased items (if in stock) for shipment within 2 to 5 working days after receiving the full sum of the order. Parcels are sent uninsured via Bpost, at the customer's risk and according to the sales conditions in force. These deadlines are not binding. No delay may constitute grounds for breaking the sale or paying compensation to the customer.

Orders are not processed on weekends and holidays, also no Saturday deliveries.

Orders are shipped with Bpost. Please ensure that the delivery address is written correctly and that someone is always present to receive the ordered package at the delivery address, signature is required.

If you know please let us know a pickup point. Saint of Love is not responsible for damage once package is delivered according to the calibrated procedure. A useful delivery address is one where someone is present for sign-off, upon receipt of the order and is highly recommended. 

If the delivery address is incorrect and the package is returned, the customer must pay the return costs (5.7 euros for Belgium).

Choose delivery to your work address, if necessary, or preferably a pickup point near you.

Items ordered through the web shop are delivered in 2 to 5 business days.

Delivery is made by Bpost.

Unless otherwise agreed or expressly provided, the goods will be delivered to the Customer's residence within 30 days of receipt of the order. 

Any visible damage and/or qualitative deficiency of an item or other shortcoming in the delivery must be reported by the customer to Saint of Love without delay.

Risk for loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) takes physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier was instructed by the Customer to transport the goods and this choice was not offered by Saint of Love. 

Article 6: Retention of title
The items delivered remain the exclusive property of Saint of Love until complete payment by the Customer. 

The Customer undertakes to draw the attention of third parties to Sain of Love's retention of title if necessary, e.g. to anyone who might come to seize items that have not yet been paid for in full.

Article 7: Right of withdrawal
The provisions of this article apply only to Customers who purchase items online from Saint of Love in their capacity as consumers.

The Customer has the right to revoke the agreement within a period of 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days from the day of the conclusion of the contract.

To exercise the right of withdrawal, the Customer must inform Saint of Love of his decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post, fax or e-mail). The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so. 

To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired. 

The Customer must return or hand over the goods to Saint of Love Brombilk 14 8210 Loppem without delay, but in any case no later than 14 calendar days from the day on which he communicated his decision to withdraw from the contract to Saint of Love.

The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer. 

The cost is estimated to be a maximum of about 12.5 euros.

The Customer is requested to return the items in their original condition and packaging, with all accessories provided, and instructions for use. If the returned item has diminished in value in any way, Saint of Love reserves the right to hold the Customer liable and claim compensation for any diminution in the value of the goods resulting from the Customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods. 

All returned items are carefully examined. The premise here is that the consumer may only inspect the item as he would be permitted to do in a store. Returned items may be tried on, but must not have been used. If an item has been impaired by the Customer's use this will be charged to the Customer.

If the Customer withdraws from the contract, Saint of Love will refund all payments received from the Customer up to that point, including standard delivery charges, to the Customer within a maximum of 14 calendar days after Saint of Love is informed of the Customer's decision to withdraw from the contract. For sales contracts, Saint of Love may wait to refund until it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever comes first. 

Any additional costs resulting from the Customer's choice of a mode of delivery other than the cheapest standard delivery offered by Saint of Love will not be refunded.

Saint of Love will refund the Customer using the same means of payment with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not be charged for such refunds.


Article 8: Warranty
Under the law of September 21, 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.
To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

The warranty (commercial and/or legal) is never applicable to defects that arise as a result of accidents, neglect, falls, use of the item contrary to purpose for which it was designed, non-compliance with user instructions or manual, modifications or alterations to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Article 10: Sanctions for non-payment
Without prejudice to the exercise of other rights available to Saint of Love, in the event of non-payment or late payment, the Customer shall be liable, ipso jure and without formal notice, to pay interest of 10% per annum on the amount not paid. Moreover, the Customer shall be liable, ipso jure and without formal notice, to pay a fixed indemnity of 10% on the amount in question, with a minimum of 25 euros per invoice. 


Without prejudice to the foregoing, Saint of Love reserves the right to take back items that have not been paid for (in full).

Article 11: Privacy
The data controller of Saint of Love, respects the General Data Protection Regulation and the Belgian Privacy Act of July 30, 2018. 

Ordering on Saint of Love automatically implies that you allow us to use your personal data for all aspects of edge management : administration, management of orders , deliveries, marketing and advertising.

Saint of Love will never share this data with third parties .

You have a legal right to access and possibly correct, supplement or delete your personal data. You may also ask to restrict the processing of your personal data in a number of cases listed in the AVG. You may also oppose the processing of your personal data if you have serious and legitimate reasons for doing so that override our need to process your data. Via a written, dated and signed request to Saint of Love Brombilk 14 in 8210 Loppem or via mail hello@saintoflove.com, you can request your personal data in digital and readable form free of charge and/or have it transferred to other controllers. Insofar as our processing is based on your prior consent, you have the right to withdraw that consent.

In case of use of data for direct marketing: You can oppose the use of your data for direct marketing free of charge and do not have to provide a reason. 

We treat your data as confidential information and will not transfer, rent or sell it to third parties.

The failure at any time by Saint of Love to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

Article 14: Modification of Conditions
These Conditions are supplemented by other conditions explicitly referred to, and Saint of Love's general conditions of sale. In case of contradiction, these Terms and Conditions take precedence.

Article 15 : Property rights and and copyright
The customer must respect all intellectual and industrial property rights vested in the items provided by Saint of Love. Nothing from this website may be stored, used or linked without the written consent of Saint of Love.

Article 16 Applicable law
All disputes connected with or arising from (the use of) the website shall be governed exclusively by Belgian law. The Belgian courts will have the exclusive jurisdiction to act in these disputes. The use of this Web site is not permitted in countries where all of these provisions, including this paragraph, do not apply.

A printed version of these General Terms and Conditions and of any warning delivered under electronic form shall be accepted in any judicial or administrative proceeding arising out of or related to these General Terms and Conditions of Use, in the same manner and under the same conditions as other documents and commercial records created and kept in printed form. All rights not expressly ceded in this document are reserved.
